Terms of Service

Introduction

These Terms of Service (“Terms”) form a binding agreement between you and Lead Skills, LLC (“Company,” “we,” “our,” or “us”), the operator of hardmoneylenderswestvalleycity.com(the “Site”). By accessing the Site, submitting an inquiry form, or otherwise using our services, you agree to these Terms. If you do not agree, do not use the Site.

Our Role: Lead Generation Service

The Site is a lead-generation service. We connect prospective borrowers with participating hard money lenders who may be able to provide financing. We do not make loans, extend credit, take loan applications, issue loan commitments, set rates or terms, or make any credit decisions. All credit decisions, including whether to issue a loan, the rate, the terms, the loan amount, and the funding timeline, are made solely by the participating lender. Participating lenders are independent third parties and are not our agents, partners, or joint venturers.

No Offer or Solicitation

Content on the Site is for general informational purposes only. Nothing on the Site constitutes an offer, commitment, or solicitation to lend, extend credit, or provide any financial product or service. Submitting your information does not guarantee that you will be matched with a lender, receive any loan offer, or receive any particular rate or terms. All loan programs are subject to borrower and property qualification by the participating lender. Rates, terms, and availability are set by participating lenders and may change without notice.

Eligibility

You must be at least 18 years old and legally able to enter into a binding contract to use the Site. You agree to provide accurate, current, and complete information in any form you submit, and to update that information if it changes. You are responsible for the accuracy of the information you provide.

Your Consent to Be Contacted

By checking the consent box and submitting an inquiry, you provide your prior express written consent for one or more participating lenders to contact you at the phone number and email address you provided, including by autodialer, prerecorded or artificial voice, SMS/text message, and email, regarding your financing inquiry. You understand that your information will be shared with one or more participating lenders who may contact you. Consent is not a condition of receiving any services or obtaining a loan. Message and data rates may apply. Message frequency varies. You can opt out at any time by replying STOP to any text message or by calling 801-516-4389. A current list of participating lenders is available upon request.

We connect borrowers with lenders who are Equal Opportunity Lenders. Participating lenders do not discriminate on the basis of race, color, religion, national origin, sex, familial status, disability, marital status, or age.

Acceptable Use

You agree not to:

• Submit false, misleading, or fraudulent information, or information belonging to another person without authorization.
• Use the Site or any submissions for unlawful purposes.
• Interfere with, disrupt, probe, or attempt to compromise the Site, its security, or its infrastructure.
• Use automated tools (bots, scrapers, crawlers) to access the Site except as permitted by robots.txt.
• Copy, reproduce, or distribute Site content except as permitted by these Terms.

Intellectual Property

All content, design elements, trademarks, logos, text, graphics, and other materials on the Site are owned by or licensed to Lead Skills, LLC and are protected by intellectual property laws. You may view and use Site content for your personal, non-commercial evaluation of our services. You may not reproduce, modify, distribute, or create derivative works without our prior written permission.

Third-Party Links and Services

The Site may link to third-party websites or services, including those of participating lenders. We do not control and are not responsible for the content, availability, privacy practices, or terms of third-party sites or services. Your interactions with any participating lender or other third party are solely between you and that third party.

Disclaimers

THE SITE AND ALL CONTENT, INFORMATION, AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY SUBMISSION WILL RESULT IN A LOAN OFFER, MATCH, OR FUNDING.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, LEAD SKILLS, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, ANY INTERACTION WITH A PARTICIPATING LENDER, OR THESE TERMS, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100).

Indemnification

You agree to indemnify, defend, and hold harmless Lead Skills, LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Site, your submission of any information, your interactions with any participating lender, or your breach of these Terms.

Governing Law

These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws principles. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Salt Lake County, Utah, for any dispute arising out of or relating to these Terms or the Site.

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Your continued use of the Site after an update indicates your acceptance of the updated Terms.
